Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Realatic CRM platform and website at www.realatic.com (collectively, the "Service"), operated by Technix Infotech LLP ("we," "our," or "us"), a limited liability partnership registered in India.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you are at least 18 years of age, have the legal capacity to enter into these Terms, and agree to be bound by them. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Account Registration

  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • One person or legal entity may not maintain more than one free account.
  • We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Send unsolicited commercial messages (spam) through the WhatsApp, SMS, or email features of the Service.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorized access to any portion of the Service, other accounts, or computer systems.
  • Use the Service to collect or store personal data about other individuals without their consent.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Use automated scripts or bots to access the Service without our prior written consent.

4. Payment Terms

4.1 Pricing

All prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes (GST) unless otherwise stated. Current pricing is available at /pricing.

4.2 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis, depending on your selected billing cycle.
  • All payments are processed securely through Razorpay. We accept credit cards, debit cards, UPI, net banking, and wire transfers.
  • You authorize us to charge your selected payment method for all fees associated with your subscription.

4.3 Free Plan

The Free plan is available at no cost and does not require a credit card. The Free plan includes usage limits as described on our pricing page. We reserve the right to modify Free plan features and limits with reasonable notice.

4.4 Upgrades and Downgrades

  • You may upgrade your plan at any time. Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of your billing cycle.
  • You may downgrade your plan at any time. Downgrades take effect at the end of your current billing cycle. Access to higher-tier features will continue until the end of the paid period.

4.5 Refunds

All paid plans include a 14-day money-back guarantee. If you are not satisfied within the first 14 days of a new subscription or upgrade, contact us for a full refund. After 14 days, fees are non-refundable except as required by applicable law.

4.6 Taxes

You are responsible for all applicable taxes, including GST. We will add applicable taxes to your invoices as required by Indian tax law.

5. Data Ownership

  • Your Data: You retain full ownership of all data you upload, input, or create within the Service ("Your Data"), including leads, contacts, projects, communications, and documents. We do not claim any ownership rights over Your Data.
  • Data Export: You may export Your Data at any time in standard formats (CSV, Excel) from within the Service.
  • Data Portability: Upon account termination, you will have 30 days to export Your Data before it is permanently deleted.
  • License to Us: You grant us a limited, non-exclusive license to access, use, and process Your Data solely for the purpose of providing, maintaining, and improving the Service.

6. Intellectual Property

  • The Service, including its original content, features, functionality, design, code, trademarks, and logos, is owned by Technix Infotech LLP and is protected by Indian and international intellectual property laws.
  • You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
  • The "Realatic" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Technix Infotech LLP.
  • You may use our brand assets only in accordance with our brand guidelines and with prior written permission.

7. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance for security or stability reasons
  • Factors beyond our reasonable control (force majeure)

8. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill.
  • Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
  • Nothing in these Terms excludes or limits liability that cannot be legally excluded or limited under Indian law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Technix Infotech LLP, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

  • By You: You may terminate your account at any time from your account settings. Upon termination, your access to paid features will continue until the end of your current billing period.
  • By Us: We may suspend or terminate your account if you violate these Terms, engage in abusive behaviour, fail to pay fees when due, or for any other reason at our sole discretion with reasonable notice.
  • Effect of Termination: Upon termination, your right to use the Service ceases immediately (or at the end of your paid period, if applicable). You will have 30 days to export Your Data. After 30 days, Your Data will be permanently deleted.
  • Survival: Sections relating to data ownership, intellectual property, limitation of liability, indemnification, governing law, and dispute resolution survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in India.

12. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service:

  • Negotiation: The parties shall first attempt to resolve the dispute through good-faith negotiation for a period of 30 days.
  • Mediation: If negotiation fails, the parties shall attempt mediation under the rules of a mutually agreed mediator in India.
  • Arbitration: If mediation fails, the dispute shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in India. The language of arbitration shall be English.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will also send notification via email or in-app message at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and terminate your account.

14. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or internet outages.
